SERVICE TERMS
I. APPLICATION OF TERMS 1. The term regulates the conditions regarding the provision of service by ONECLICK HOSTING LTDA to the service taker. 2. It regulates the rights and responsibilities of both the provider and the service taker. 3. The terms are applicable from the date of electronic acceptance of the same. 4. Words indicating singular include their plural and vice versa unless explicitly stated. 5. The provider is understood as the service provider and the user as the service taker. II. GENERAL CONDITIONS 1. The user agrees not to use or contract any service from the provider if they have not accepted and/or do not agree with the terms described here. 2. No abusive action can be justified by indicating involvement of third parties. The user is responsible for actions taken on purchased or rented services. 3. The provider is not responsible for failures and unavailability caused in third-party services, beyond the level of action and control (such as access providers, for example). 4. In case of non-compliance with the term by the provider, the user has the right to request a refund for their last billed invoice. 5. In case of non-compliance with the term by the user, the provider reserves the right to interrupt support requests that are in progress until the non-compliance is rectified. 6. The persistence of non-compliance may result in temporary suspension or cancellation of the service. 7. In case of identified abuse, the provider will take necessary measures to interrupt the incident as soon as possible. Depending on the severity of the problem, the provider may immediately suspend the service. The provider will then seek joint resolution with the user. The user does not have the right to demand immediate reactivation of the service if its execution poses a risk of another incident. 8. If illegal activities are identified, the provider reserves the right to provide additional information to competent legal authorities. III. CONTENT 1. The provider undertakes to provide all services redundantly to protect against hardware failures. 2. It is the user's responsibility to back up their data outside the provider's infrastructure. 3. The provider cannot be held responsible in case of data loss due to accidental removal by the user. 4. The user is responsible for any content stored on the service. IV. BILLING AND PAYMENT 1. The invoice for services is calculated according to the prices advertised on the website, including promotions in external advertisements and partner sites. 2. Email reminders are sent for manual payments and informative messages confirming payment in all modalities (manual and automatic payments). 3. Services that are turned off, deactivated, or suspended are charged in the same way as an active service. This charge is to cover data storage costs. Service suspension does not affect the invoice due date. 4. In case of service cancellation, all respective unpaid invoices will be automatically canceled. 5. The provider reserves the right to refuse any service update if there are overdue invoices. In this case, the user is advised to settle them before requesting the update. V. SUSPENSION AND CANCELLATION 1. The service can be canceled by the user at any time, through the button located in their account panel. 2. The provider may cancel the service only in case of violation of the Terms of Service by the user. The service may be canceled in this case without prior notice. 3. Services with overdue invoices beyond the deadline will be automatically suspended. The deadline is explicitly indicated in the account panel. 4. There is no guarantee of preservation of numbering resources (IPv4/IPv6) after service suspension, and they may be changed after reactivation. 5. Services that have been suspended for more than the deadline will be automatically canceled. Service cancellation is permanent and cannot be undone. The deadline is explicitly indicated in the account panel. 6. Data stored on the service is maintained during the suspension period but permanently deleted on the cancellation date. All dates are indicated in the account panel and notified via email. 7. The provider reserves the right to cancel the service immediately in case of identification of at least one item listed in the "PROHIBITED ACTIVITIES" category of this term of service. VI. PROHIBITED ACTIVITIES 1. Actions with data protected by copyright without prior authorization. 2. Server for the purpose of sending unsolicited email (spam) or sending harmful software. 3. Sharing illegal files via torrent protocol. 4. Abusive actions against other servers or users. 5. Scamming/phishing. 6. Cryptocurrency mining. 7. Malicious use to disrupt server operation. 8. Flood or amplification attacks. 9. Hosting of illegal content, child pornography, racist content, or content that incites hatred and violence. 10. Any other type of activity considered illegal. VII. PRIVACY 1. To use the website and services, the user needs to register their personal information. 2. The collected information is not disclosed to third parties except to the commercial transaction operator used in billing invoices. 3. The provider may collect generic information at each user visit to improve the security, stability, and responsiveness of the services provided. 4. Among the collected information are the access IP address, browser version and characteristics, access reference, and cookies. VIII. SUPPORT 1. The provider reserves the right to refuse support to those who do not have an active contracted plan and are not eligible for the requested type of support. 2. Those who do not have an active contracted plan may request support related to assistance in contracting and choosing a plan and/or service. 3. The provider has the right to refuse support provision in cases not directly related to the service provided (configuration of third-party applications, for example). IX. WEBSITE HOSTING 1. The website hosting service guarantees necessary services for the full functioning of a dynamic PHP website. Among the available services are: HTTP/HTTPS, FTP, DNS, SMTP, POP3, IMAP, and MySQL. 2. The provider undertakes to deliver all respective services in shared hosting format. 3. The service solely and exclusively configures website hosting. The user is responsible for contracting the domain with the responsible body or reseller. 4. Likewise, the user is responsible for creating, maintaining, and changing the content of the hosted website. 5. The website hosting service is provided with the intention of providing standard website hosting. Thus, usage as a torrent server, streaming, and proxy is not allowed. X. VPS SERVERS 1. The user is responsible for actions taken through the account panel, including state operations and operating system reinstallation. 2. VPS servers are delivered in shared environments. In case of excessive use, processing performance may be automatically restricted to equalize its usage with other servers. 3. Access bandwidth may be automatically restricted for security if it exceeds the limit calculated based on usage statistics for a certain period. The restriction is automatically deactivated when the situation is normalized. 4. Any activity performed on the server is the user's responsibility during the contract period, and connection information may be provided to legal authorities upon official request. XI. ADDONS 1. The MySQL database service does not impose a limit on the number of tables, but it may be restricted if the total size of the database exceeds 10GB. 2. Similarly, the MySQL service may be restricted if abuse and/or excessive numbers of connections or queries are identified within a short period of time. 3. In both cases (items 1 and 2), there will be advance notification via ticket before any restrictions are applied. XII. AFFILIATE PROGRAM 1. The accumulated amount can be redeemed through available means (PagSeguro, MercadoPago, or PIX). 2. A personal identification document may be required after a redemption request. 3. Chargebacks/pro-rata payments are not counted towards the accumulated balance. 4. Redemption will be made to a bank account under the same ownership. 5. There will be a refusal in cases of fraud (such as accounts used by the same person, for example).
